This process can often eliminate the need for court. Free Consultation
We begin with a complimentary phone or virtual consultation to understand your needs and determine if Family Mediation is the right fit.
Agreement to Mediate
Before sessions begin, all parties sign an agreement to mediate outlining confidentiality, expectations, and consent.
Intake & Screening
Each party participates in a one-on-one intake session to assess safety, readiness, and goals.
Process Design
Together, we design a Fairhaven Family Mediation process tailored to your family’s needs. This could be in person or virtual, joint or shuttle. See FAQ for more details.
Mediation Sessions
We practice closed mediation, which means everything discussed is confidential and cannot be used in court.
This creates a safe space for open dialogue and creative problem-solving. Together, we work toward a parenting plan or separation agreement that reflects your family’s needs. The mediator helps clarify priorities, explore options, and document decisions.
Mediation Summary Report or Memorandum of Understanding
A written summary of outcomes and agreements is provided.
Independent Legal Review
While mediation helps families reach mutual agreements, these are not legally binding until reviewed and formalized.
We strongly recommend that each party seek independent legal advice to ensure the agreement is fair, enforceable, and aligned with your rights and responsibilities.
Formalize the Agreement
Your lawyer may help you turn the mediated agreement into a legally binding document, Such as a Parenting Plan or Separation Agreement
File with the Court (if needed)
In some cases, you may file the agreement with the mediation process in family court to make it enforceable.
